The objective of this document is to provide guidance to Humanitarian Financing Units (HFUs) on the management of non-compliance by Country-Based Pooled Fund (CBPF) partners with the requirements contained in these Global Guidelines, the Fund-specific Operational Manual, and/or the Grant Agreement – other than those related to serious misconduct such as fraud and Sexual Exploitation or Abuse (SEA) which are dealt with through applicable Standard Operating Procedures.
The framework highlights common instances of non-compliance and suggests progressive measures that could be applied to address them. Measures are suggested rather than mandatory – the framework provides guidance around practices that each Fund can apply on a discretionary basis, while recognising that the context in which each Fund operates, and the specificity of any given partner relationship needs to be taken into account.
Measures to address non-compliance are managed by the HFUs under the discretion and authority of the Humanitarian Coordinator (HC) and OCHA Country Office. OCHA HQ provides guidance to HFUs in the application of these measures. The HC or OCHA will communicate to the partner about the measures imposed, the reasons, and the potential conditions for lifting such measures. If non-compliance persists, the HC may suspend the partner’s eligibility to receive funding.
The extent to which this framework will be applied depends on further development of GMS functionalities to enable the sequence of steps outlined.
